Safety and Buildings Division staff met with advisory code councils in early March to continue consideration of public hearing comments and legislators' comments about the proposed adoption in Wisconsin of building and fire codes based on national model codes.
The public hearings were held in January and a number of state legislators also have reviewed the code package proposal. The national model codes that are proposed for adoption as the basis for the Wisconsin code rule package are the International Building Code (IBC), the International Energy Conservation Code (IECC), the International Mechanical Code (IMC), the International Fuel Gas Code (IFGC), and the International Fire Code (IFC). S&B projects being able to have the package adopted and in print by late summer of 2001. There is an anticipated block of time between the adoption and the effective date, to allow designers time to get current projects off the drawing boards, and for users to gain a sure knowledge of the new codes. An effective date is projected for July 2002. An analysis of the proposed rules and the draft rules themselves are available on the S&B WebSite, www.commerce.state.wi. us/SB/SB-HomePage.   2. Building, HVAC plan submittal kit also includes other program forms
A revised 100-page "Building and HVAC Plan Submittal Kit" is now available from the Safety and Buildings Division. The kit not only contains forms, worksheets, and information for building project plan reviews, but also has forms for reviews for plumbing, POWTS, swimming pools, and elevators.
The newly revised kit now also includes information about fire protection system plan reviews. The kit is available free of charge from the S&B Materials Distribution Section. At this time there are no appointed agents for fire protection system plan review, but S&B is working towards partnering with municipalities and fire departments to have those local entities conduct the plan review on S&B's behalf.
  3. Initial draft of NFPA fire code released
Release was announced in February of a new fire prevention code, NFPA 1-Uniform Fire Code, developed by the Western Fire Chiefs Association and the National Fire Protection Association.
According to the NFPA press release, "The first edition of the combined code is currently in the NFPA Fall 2002 cycle with a proposal closing date of June 8, 2001. A final document will be issued by the Standards Council in January 2003. The complete development cycle is available from NFPA's web site, www.nfpa.org. The document draft is available for downloading, and individuals can review and submit proposals online. For printed copies or CD-rom versions, please call NFPA's Standards Administration, 617-984-7249."   5. Brandt retired
Richard Brandt, a Safety and Buildings Division Industrial Hygienist, retired March 2, 2001. He served for over 20 years, protecting the health and safety of public sector employees. His diligence in ferreting out indoor air quality problems greatly enhanced the quality of life for many workers in Wisconsin.
  6. Fire Safety Consultant passed away
Lyle's Smith's battle with cancer ended with his death February 22, 2001.
Smith began as a Fire Safety Consultant with the Safety and Buildings Division on September 14, 1994, providing consulting services to the southeastern Wisconsin from the Waukesha S&B office. His co-workers and the people he assisted appreciated his abilities and gentle manner.
  7. "Is your municipality certified?"
Review and inspection options for local authority

For many years the simple question: "Is your municipality certified?" defined the local building review authority of municipalities in Wisconsin.
Municipalities recognized as "Certified" were delegated authority to perform limited plan examination on behalf of the state plan review authority administered by the Safety and Buildings Division, as well as inspection of either those structures they reviewed, or inspection of all structures. Following a change to administrative rules last fall, S&B now permits greater flexibility in the options available to municipalities. Options now available to S&B's municipal partners: *First class cities authority,
*Second class cities authority,
*Certified municipality authority, and
*Appointed agents authority.
The City of Milwaukee is currently the only "First Class City" in Wisconsin, a classification with delegated plan examination and inspection authority prescribed in statute and administrative rules. The first class status requires review and inspection of all buildings and structures within the city limits. Municipalities within a certain definition have a "Second Class City" designation. A second class city may request "expanded" plan review and inspection delegation of all buildings and structures located within the city limits. Representatives of proposed projects within those cities have the option to submit plans for review to the second class city or to S&B. At the moment, none of the dozen or so second class cities in Wisconsin have requested the expanded plan review delegation, although they have been "certified" cities in terms of building project authority. (Special delegation agreements the cities of Madison and Janesville have had with S&B served as outlines for the new "Appointed Agent" process noted below.) "Certified Municipalities" have been able to do plan review for new buildings not exceeding 50,000 cubic feet, for additions to existing buildings which will result in the total building volume not exceeding 50,000 cubic feet, and for alterations not exceeding 10,000 square feet. New rules in 2000 expanded the delegation to include review of additions to any commercial building up to 2,500 square feet with maximum roof spans of 18 feet and maximum wall height of 12 feet. Proposed projects can be submitted to either the certified municipality or to S&B. The category of "Appointed Agent" provides cities, towns, villages, or counties the flexibility to request from S&B the delegation of specific responsibilities. A municipality or county may request plan examination delegation based on construction classification, occupancy classification, or any combination of review parameters. Proposed projects can be submitted to either the appointed agent or to S&B. There is now one new "Appointed Agent," Oak Creek. See article on page 5. S&B now has in place a system for processing municipalities' requests to be "Appointed Agents." The appointed agent procedure also includes the flexibility to have delegation to a municipality inspection (while not doing plan review) of buildings and structures as an appointed agent of S&B.   8. Oak Creek leads the way as appointed agent
The city of Oak Creek is the first municipality in Wisconsin which has been delegated an "Appointed Agent" of the Safety and Buildings Division.
Following new rules adopted last fall in Comm 50.22, Oak Creek requested from S&B the authority to conduct expanded plan examination within the city limits. See article above. Under this delegation, S&B has authorized Oak Creek to perform plan examination of all buildings classified as construction types 5B (unprotected masonry), type 6 (unprotected metal frame), and type 8 (unprotected wood frame), simple span or pre-engineered framing, and not to exceed two stories in height. Oak Creek will continue to review alterations as prescribed under the city's delegation as a "Certified Municipality." Also, Oak Creek will continue to perform inspections of buildings and structures. Plan submitters of project within Oak Creek have the choice of either submitting projects to the S&B or the city of Oak Creek.   9. Program "supervisors" have cooperative and specific duties
There are staff in each of the three Safety and Buildings Division bureaus who share responsibilities for "supervising" the division's programs. While they are liaisons for cooperatively planning and implementing policies and processes, the Section Chiefs in the Bureaus of Integrated Services (IS) and Field Operations (FO) and the Program Managers in the Bureau of Program Development (PD) also have more specific duties. The section chiefs are personnel supervisors of bureau staff working in various programs. In IS those are (generally) consultation, plan review, evaluation, and support staff, and in FO (generally) inspectors, consultants, and support staff. Program managers are the leaders in program planning and development. Below, these chiefs and managers are listed by last name according to their program assignments.
